GM initially agreed to invest in Lithium Americas in exchange for lithium from Thacker Pass.[195] In October 2024, however, the two companies announced a joint venture in which General Motors would pay $625 million in cash and letters of credit to take a 38 percent ownership interest in the Thacker Pass mine itself.[196] The joint venture will fund, develop, construct and operate the Thacker Pass mine.[197] The Need for a Just Transition Indigenous peoples, human rights groups, and environmental groups, while underscoring the urgency of a transition away from fossil fuels, have expressed concern the increase in mining needed for renewable energy, both for lithium and other materials, will result in harms to Indigenous peoples, local communities, and the environment if not done in a way that upholds relevant human rights standards.[198] Globally, more than 54 of current or future transition minerals projects are located on or near Indigenous lands.[199] Tribal advocates in the US have emphasized the risks to Indigenous peoples rights from increased transition-related mining.[200] While the extent of traditional and ancestral lands differ greatly depending on context and are rarely equivalent to reservation boundaries in the US, one study has indicated that 79 percent of all known lithium reserves in the US are located within 35 miles of Tribal reservations.[201] In a July 2024 submission to the UN Secretary Generals Panel on Critical Energy Transition Minerals, which was launched in April 2024, more than 300 Indigenous peoples, environmental, labor, and human rights groups called for governments and companies to protect and respect Indigenous peoples right to self-determination and to free, prior, and informed consent prior to and during minerals licensing, extraction and processing.[202] The groups also called for efforts to reduce the need for new mining by reducing energy and material use and increasing responsible use, especially in developed countries.[203] In September 2024, the UN Panel ultimately issued seven Principles to Guide Critical Energy Transition Minerals Towards Equity and Justice, underscoring in its first principle that, human rights must be at the core of all mineral value chains.[204] The panel called on all actors to uphold the rights of Indigenous peoples, including by obtaining their free and informed consent prior to the approval of any project affecting their lands or territories and other resources.[205] Indigenous activists and civil society groups in the US have expressed concern that the countrys outdated federal mining laws, coupled with inadequate requirements for consultation and consent from Indigenous peoples, risk perpetuating harms against Indigenous communities.[206] Permitting Process for the Thacker Pass Mine The US government approved permits for the Thacker Pass mine in less than a year, far faster than the three-year average it typically takes to permit a new mining operation
